Abstract

Modern Israeli trust law developed from below: both private clients and entrepreneurs demanded and used it since the 1930s, while the trust form only entered domestic positive law in 1979. The trust regime finally enacted was quite odd, not requiring that for a trust to exist, title to trust assets be held by the trustee. The rule against perpetuities was never applied to inter vivos trusts, and purpose trusts, for any purpose, were allowed.
