Abstract

This open-access constitutional law casebook is the product of a collaborative effort involving more than 40 constitutional law teachers from across Canada.

While primarily intended as a teaching tool for law students, this casebook is also designed to serve a broader audience. Whether you are a student, researcher, practitioner, or simply a curious reader seeking to better understand the Canadian constitutional order, we hope you will find this resource useful and accessible.

The casebook focuses on many of the foundational elements of Canada’s constitutional structure. It addresses themes such as federalism, the separation of powers, constitutional rights and Indigenous sovereignty. That said, this is not a comprehensive treatment of the entire field. Choices had to be made about scope and depth, and some areas are treated more fully than others.

We believe, however, that this casebook offers a strong foundation for critical engagement with Canadian constitutional law. We are grateful to the many contributors who volunteered their time and expertise to make this resource possible, and we hope it will continue to evolve and grow through feedback and future collaboration.
